Panama is one of the most foreigner-friendly real estate markets in Latin America — and arguably the world. Foreigners enjoy exactly the same property ownership rights as Panamanian citizens, the economy runs on U.S. dollars, and the legal framework for property transactions is robust and transparent. This guide covers everything you need to know before you buy property in Panama.

Can Foreigners Buy Property in Panama?

Yes — and without any restrictions. Panama's Constitution grants foreigners the same property rights as citizens. There are no limits on the number of properties you can own, no restrictions on the type of property (residential, commercial, land), and no requirement to live in Panama or even visit regularly. This makes Panama one of the most open real estate markets in the world for international buyers.

The only exception applies to properties within 10 kilometers of an international border or on certain island territories, where a special concession may be required. In practice, this rarely affects residential or commercial buyers in Panama City or the major beach markets.

"Owning property in Panama as a foreigner is legally identical to owning it as a Panamanian citizen — same rights, same protections, same title registry."

Step-by-Step: How to Buy Property in Panama

Step 1 — Define Your Goals and Budget

Before anything else, clarify what you're buying for. Are you looking for a primary residence, a rental income property, a vacation home, or a long-term investment? Your answer will determine the neighborhood, property type, and price range that make sense. Panama City offers very different opportunities from the beach markets of Coronado or Bocas del Toro.

Budget beyond the purchase price: factor in closing costs (typically 2–4% of the price), attorney fees, property transfer tax (2% of the registered value), and ongoing property taxes (usually very low — Panama offers generous exemptions on new constructions).

Step 2 — Choose Your Location

Panama City is by far the most liquid and active market for foreigners buying property in Panama. Key neighborhoods to consider:

Step 3 — Find Your Property

The Panamanian market is notably less transparent than markets like the United States — many of the best properties are never publicly listed. Working with a licensed, experienced real estate broker is strongly recommended. A good broker will have access to off-market listings, pre-construction deals, and distressed assets at below-market prices that you simply cannot find on your own.

Step 4 — Perform Due Diligence

This is the most critical step when buying property in Panama and the one most foreigners skip at their peril. Due diligence means thoroughly verifying the property's legal status before you commit a single dollar. Key checks include:

Panama's Public Registry is generally reliable, but errors and outdated records exist — particularly with older properties, distressed assets, and rural land. A licensed Panamanian attorney must conduct this review. Our team coordinates this process entirely and delivers a full due diligence report in English.

Step 5 — Make an Offer and Sign the Promise to Purchase

Once due diligence is complete and you're satisfied, you'll sign a Promesa de Compraventa (Promise to Purchase agreement). This is a binding contract that locks in the price and terms. A deposit of typically 10% of the purchase price is paid at this stage and held in escrow. Your attorney will review and negotiate the terms of this agreement.

Step 6 — Closing at the Notary

The final purchase deed (Escritura Pública) is signed before a Panamanian Notary Public. Both buyer and seller (or their authorized representatives via Power of Attorney) must be present or represented. The remaining balance is paid, typically via wire transfer. The notary then submits the deed to the Public Registry, where the title is officially transferred to your name. This process typically takes 30–60 days after signing.

Can Buying Property Give Me Residency in Panama?

Yes. Panama's Qualified Investor Visa grants permanent residency to foreigners who invest a minimum of $300,000 USD in Panamanian real estate. The property must be titled and free of liens. This visa has no minimum stay requirement — you don't have to live in Panama to maintain it. It's one of the most accessible and well-regarded residency-by-investment programs in Latin America.

Common Mistakes Foreigners Make When Buying Property in Panama

  1. Skipping due diligence — The most costly mistake. Never buy based on a seller's word or a listing description alone. Always verify the title, liens, and legal status independently.
  2. Not using a local attorney — Panamanian real estate law has specific requirements. Foreign legal frameworks don't apply here.
  3. Paying without escrow — Always use a licensed escrow service for deposits. Never wire money directly to a seller before the deed is signed.
  4. Buying pre-construction without vetting the developer — Panama has had cases of developers going bankrupt or failing to deliver. Research the developer's track record thoroughly.
  5. Ignoring the title type — Panama has titled land (most secure), rights of possession (less secure), and concession land. Make sure you know what you're buying.
